Terms of Service – K2 Website Design


In general, proposals are valid for three months, hour estimates are based on a Time and Materials basis, K2 Website Design (K2) requests 50% of payment up-front, and the second 50% of payment when a website is launched. Authorization to proceed is given once the first 50% of payment is received by K2 and the Proposal has been electronically signed by CLIENT. Hosting and maintenance fees begin once the Proposal has been electronically signed by CLIENT. CLIENT will provide K2 with feedback within two weeks of receiving the draft website. If no feedback is provided by CLIENT within two weeks of receiving the draft website, the second 50% of payment will be due. Please note that payments to K2 Website Design are non-refundable. K2 reserves the right to reject service to any individual, company, or corporation at any time. The website design will be the property of K2 until the website is launched. K2 reserves the right to place "Powered by K2 Website Design" and the K2 logo in the footer of the Client's new website, and to show the CLIENT's new website in K2's portfolio. Fees described herein do not include fees associated with the domain name. Monthly fees for hosting and ongoing maintenance services are subject to increase at any time at the discretion of K2, however, they will not be increased without the approval of CLIENT. K2 will make reasonable efforts to ensure the functionality and uptime of the CLIENT's website, but does not guarantee uninterrupted or error-free performance. All services are provided “as is” and “as available,” without warranties of any kind, express or implied. CLIENT assumes full responsibility for the content and legal compliance of the website. K2 shall not be liable for any indirect, incidental, or consequential damages, including lost profits or data, and total liability shall not exceed the amount paid by CLIENT. CLIENT agrees to indemnify and hold harmless K2 from any claims arising out of their use of the website or breach of these terms. K2 is not responsible for delays or failures caused by events beyond its control, including but not limited to natural disasters, internet outages, or third-party service interruptions.
